CAUSED THE BOARD TO ENFORCE THE NO FIREWORKS WITHIN 600 FEET OF ANY PUBLIC SCHOOL LAW:

My rationale for bring up the matter and asking that the District make an effort to enforce the law stemmed from my concern that if a school building were to catch fire which resulted in damage, and there was no evidence that the District had tried to enforce the law, that our insurance provider might have legal recourse to not have to pay for the damage.  I could see no sense in taking such a chance when a little publicity about the law and signs at every school would cover that aspect of due diligence by the Board and the Administration.  MM

SUBJECT:  Fireworks on School Grounds

DATE:  May 27, 1992

-------------------------------------------------------------------------------------------------------------------------

It has been brought to my attention that we have had some trouble around July 4th each summer with students using school grounds as a site to explode fireworks.  Please remind your students that igniting or exploding fireworks within 600 feet of any school is a violation of State law, specifically Article 5.43.4 of the Insurance Code.  This offense is a Class B misdemeanor, which is punishable by up to a $1500 fine and/or up to 180 days in the County jail.

Several police agencies have been notified of the problem and will be monitoring school grounds, especially during that time.  Thank you for your attention to this matter.
